Vastpay Services

Vastpay expects it's ethics and values to be upheld in all it's operations. It complies with applicable local laws. You are advised to go through our policies carefully and keep visiting us for further updates.

Acceptance

Upon registering on the Vastpay platform, to use some features or avail a certain service, you agree to accept the SSOID terms and conditions as well as the service specific terms and conditions. You are also bound to accept all the amended and added terms and conditions in relation to the SSOID or other modified terms and conditions in relation to the service offered by Vastpay on it's platform. Upon using, registering or browsing through Vastpay, you automatically agree to all the terms and conditions. If you do not agree with the terms and conditions of Vastpay, you will not be able to use Vastpay’s services. Acceptance of the T&Cs means that a contract by default has been signed between you and Vastpay which expects you to be 18 or above and be the sole user of your Vastpay account. All the services provided to you will be available on the Vastpay platform under the brand name ‘Vastpay’. You may use the Vastpay Services provided that you comply with the T&Cs. You shall enjoy the privilege of the services rendered to you by Vastpay if you agree with the T&Cs.

Eligibility

The services offered by Vastpay are only for individuals who are 18 or above. By accepting the T&Cs you accept that you are 18 or above and have not been previously terminated from Vastpay. Also, Vastpay has the right to remove your account permanently if you have given false information about your identity or otherwise misrepresent your age or affiliation with any person or entity.

Other Terms and Conditions

Communication Policies

Upon registering for the SSOID service on the Vastpay Platform, Vastpay may send alerts to the mobile number provided by you or to any updated mobile number subsequently provided by you on the Vastpay Platform, or by e-mail or push notifications. SMS notifications will be received if the user has enabled receiving SMS immediately, while e-mail notifications will be received if the email server and account have been confirmed, and push notifications will be received if the user has enabled receiving such notifications. You may not get a notification if the mobile phone is in 'Off' mode, or if the email servers or ids are not functioning, or if the push notifications are turned off.

Vastpay will make it's best efforts to provide alerts via SMS/e-mail/push notifications and it shall be deemed that you shall have received the information sent from Vastpay as an alert on the mobile phone number or e-mail id provided during the course of, or in relation to Vastpay would not be obliged to confirm the originality of the person receiving the alert and neither can it be held accountable for the non-availability of the notification service in any manner whatsoever.

You give Vastpay permission to contact and communicate with you about any Vastpay service or offer. Vastpay may employ the services of third-party service providers to send alerts or communicate with you. You authorise Vastpay and Vastpay Entities to contact you via calls, SMS, emails, and any other mode of communication that is not blocked by your DND settings.

Vastpay’s SMS/e-mail alert/push notification service is an additional service provided for your convenience, and it is subject to error, omission, and/or inaccuracy. If you notice any errors in the information provided in the alert, you must notify Vastpay right away, and Vastpay will make all reasonable efforts to correct the error as soon as possible. You do not have the authority to hold Vastpay liable for any loss, claim, damage or expense, including the legal costs incurred/suffered as a result of the SMS/e-mail alert/push notification facility.

The clarity, readability, accuracy, and promptness with which the SMS/e-mail alert/push notification service is provided is determined by a variety of factors, including the service provider's infrastructure and connectivity. Vastpay is not responsible for any non-delivery, delayed delivery, or misrepresentation of the alert.-You agree to indemnify and hold Vastpay and the SMS service provider, including it's officials, harmless from any and all damages, claims, demands, proceedings, losses, costs, charges, and expenses, including legal fees and attorney's fees, that Vastpay or the SMS service provider may incur, sustain, suffer, or be subjected to as a result of, or arising out of, any of the following: (i) You misbehaved or provided incorrect or fraudulent information; (ii) You provided an incorrect number or a number belonging to an unrelated third party; (iii) the customer received any message from Vastpay and/or the SMS/e-mail service provider relating to the reservation number, travel itinerary information, booking confirmation, ticket modification, ticket cancellation, change in bus schedule, delay, and/or rescheduling of the trip.

Use of the Vastpay platform

You acknowledge that, with the exception of information, products, or services clearly identified as being provided by Vastpay, we do not operate, control, or endorse any information, products, or services on the Internet. You also acknowledge that Vastpay cannot and does not guarantee or ensure that files downloaded through the Vastpay Platform are virus-free or devoid of other potentially dangerous code. You are responsible for implementing procedures to meet your specific Internet security requirements, as well as for the accuracy of data input and output.

Prohibited Conduct

While accessing/using the Vastpay platform or services, you agree not to:

1. Breach the T&Cs.
2. Put your responsibility for implementing procedures to meet your specific Internet security requirements, as well as for the accuracy of data input and output, on us.
3. Actively break the terms of our or any third party’s intellectual property rights, rights of publicity or privacy.
4. Use the Vastpay services if you’re under 18 years of age without parental sponsorship or even with parental sponsorship if you’re under 13 years of age in accordance with applicable law.
5. Post or transmit any pornographic, vulgar, or offensive message, data, image, or program or any data or information that might cause defamation or disclose the personal matters of a person of any kind.
6. Decline cooperation for the confirmation of your identity in an investigation or any information demanded by you by Vastpay.
7. Pull out, avoid, incapacitate, damage or otherwise hinder with the security related items of the Vastpay services and the Vastpay platform or to impose restrictions on the utilization of the Vastpay platform or it's services.
8. Reverse engineer, decompile, deconstruct or try to discover the source code as regards Vastpay’s platform, it's services or any part, except and only to the length that is permissible by applicable law.
9. Make use of the Vastpay’s platform or services that in any form can damage, incapacitate, disable, including, without restrictions, using the Vastpay’s platform and services in an automatic manner.
10. Alter, adapt, interpret or make plagiarized works based upon Vastpay’s platform and services or any part, except for the one permissible by applicable law.
11. Deliberately obstruct with or damage operations of the Vastpay’s services or the Vastpay’s platform or any other user’s utilization of it, or upload disseminating viruses, adware, spyware,worms, or other spiteful code or file with disruptive or foul features.
12. Use any machine, system, spider or other such automatic machines to monitor or duplicate the Vastpay platform without any prior written permission.
13. Obstruct with or derange the Vastpay Platform or networks connected to it.
14. Take any action that places an unreasonable or disproportionately huge load on Vastpay’s network or infrastructure.
15. Sell the Vastpay services, data, or software associated with or originated from it.
16. Utilise the Vastpay Platform's facilities and capabilities to conduct or solicit the performance of any criminal activity or other activity that breaches with the rights of others.
17. Give inaccurate or misleading information.
18. Break the SSOID Agreement or any other agreement or policy as may be applicable pursuant to the T&Cs.
19. Take any action that could result in Vastpay losing any of it's services, service, recharge partners or business partners, including mobile operators or telecom firms, payment processors, or other providers.
20. Send any requests to Vastpay without taking permission prior to it.
21. Use the payment gateways or card network in a way that it is believed to be an abuse of the payment card system or a violation of payment card network rules.

Termination;Agreement Violations

You give your consent that Vastpay has the right to suspend or permanently remove your account, any part of it, your activity on the app or website, user profile and recipient profile, including your SSOID, at any time. Vastpay also holds the authority to dismiss access to it's services with or without notice. You agree that Vastpay will neither be answerable nor liable to you or any third party for any interruption. Any suspected fraud, abuse or illegal activity may be reported to the appropriate law enforcement authorities. If terminated, you agree to immediately stop using the Vastpay platform or it's services.

Limitation of Liability and Damages

Under no case will Vastpay or any of it's contractors, licensors, agents, partners or provisioners be held responsible under any kind of damage (pecuniary or non-pecuniary loss or damage of any nature whatsoever), relating to:

1. This Agreement
2. The SSOID Agreement
3. The Vastpay services
4. Your use or inability to use the Vastpay Services. You know and agree that Vastpay has provided it's merchandise and services, set it's prices, and entered into this agreement in reliance upon the guarantee disclaimers and the restrictions of legal responsibility set forth herein, that the guarantee disclaimers and the restrictions of legal responsibility set forth herein replicate an inexpensive and truthful allocation of threat between you and Vastpay, and that the guarantee disclaimers and the restrictions of legal responsibility set forth herein shape an vital foundation of good business among you and Vastpay. Vastpay could now no longer be capable of offer the offerings to you on an economically affordable foundation without those boundaries. Applicable regulation might not absolutely permit the hassle or exclusion of legal responsibility or incidental or consequential damages, so the above boundaries or exclusions will apply to relevant regulation. In such cases, Vastpay’s legal responsibility might be restricted to the fullest quantity authorised through relevant regulation. This paragraph shall live to tell the tale of the termination of this Agreement.

Indemnification

You acknowledge to indemnify, save, and keep Vastpay, it's affiliates, employees, officers, administrators, and companions harmless from any and all claims, losses, damages, and liabilities, charges and expenses, which include without hindrance, criminal charges and expenses, bobbing up out of or associated to:

1. Your use or misuse of the Vastpay services or platform and the violation of the terms and conditions related to the SSOID.
2. Any kind of violation of the presentations, guarantees, and contracts made by you. Vastpay has the right to control a situation for which you are required to indemnify Vastpay and you agree to settle the claims and cooperate in the defense of the company.

Disclaimer;No Warranties

Vastpay does not give any guarantee, statutory, express or implied. No piece of information that you have obtained from Vastpay, verbal or written, gives any guarantee or warranty other than those stated herein. You fully acknowledge that the word "Vastpay" as used in this section includes it's officers, directors, and employees for the purposes of this Disclaimer. You agree that Vastpay is not answerable on behalf of any of the third parties (telecom companies, mobile operators, or suppliers) or to the subscribers of these telecom companies connected to us. You also acknowledge that you are using the services rendered to you by Vastpay at your own risk and any kind of errors, viruses, or other harmful components in Vastpay’s platform and services are not the responsibility of Vastpay. If you suffer from any kind of loss in terms of data, mobile phone or computer due to using or doing business through Vastpay, we will not be held responsible for it. We do not make any kind of warranty and, thus, you should not be dependent on any such statement. The Survival clause specifies that the contract provisions will remain in effect after the termination or expiration of the agreement. In the case of your inability to use Vastpay, you will solely be responsible and liable for any loss of profit's, business interruption, loss of programs or information, and other such losses.

Ownership;Proprietary Rights

Vastpay’s platform and services are the property of Vastpay it'self, including the interface, information, software, design, graphics, services, data, and all other such components are protected by Indian copyright, trade dress, patent, and trademark laws, international conventions, and all other applicable intellectual property and proprietary rights, and applicable laws. You agree not to eliminate, hide or amend Vastpay or any of it's third-party trademarks or copyright, other proprietary rights accessed in conjunction with Vastpay’s platform and services. You undertake not to sell, license, distribute, reproduce, change, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorised use of the materials unless expressly approved by Vastpay. If you have any suggestions as to how Vastpay can improve, feel free to contact customer care.

Modification of this Agreement

Only Vastpay holds the authority to add, remove, amend or modify any parts of this agreement and will notify you through notifications on the app and the website or by communicating a message to you. If you do not agree or approve of any changes, your Vastpay account will be terminated, including all the services it had been offering to you prior to the termination. Vastpay will, however, be required to send you advance notice and will do so. If you continue using Vastpay following the changes, then it means that you are readily accepting all the terms and conditions.

Notice

Vastpay may send you notice through e-mail, SMS, push notifications, regular mail, or postings on the Vastpay Platform or by any other logical means. Notice to Vastpay must be sent by email on our email address : contactus@vastpay.in

Waiver

Any waiver of any provision is only valid if it is in written form and signed by Vastpay. it's failure to enforce any right does not constitute a waiver of that right.

Dispute Resolution

In cases of disputes (in relation to the agreement, services or platform of Vastpay), the parties should use all reasonable arguments and points to solve the dispute amicably. If the parties are unable to resolve the disagreement amicably within 30 days of receiving notice of the problem, Vastpay may decide to resolve the dispute through binding arbitration under the Indian Arbitration and Conciliation Act, 1996(hereinafter the Act). Every detail of the dispute shall be kept private and none of the two parties (you or Vastpay) shall disclose the existence, content or results of any arbitration, except as may be required by law or for the purpose of enforcing the award. All the fees or the amount of money spent on the arbitration shall be equally divided between you and Vastpay. However, the expenses of the lawyers, preparation and administrative work should be settled individually.

Governing Law and Forum for Disputes

Subject to the Disagreement Resolution section, you agree that any claim or dispute you may have against Vastpay must be resolved by a court with jurisdiction in New Delhi, India. The agreement shall be ruled by Indian law.

Severability and Survival

If any term of this agreement is found to be illegal, null, infirm, or otherwise ineffective, that provision will be limited or taken out to the necessary extent, with the remaining sections being valid and effective. Any provision that, by it's nature or stated words, should survive the termination or expiration of this Agreement shall survive such termination or expiration as applied to transfers and relationships that occurred prior to the termination or expiration.

Vastpay Recharges

Vastpay only works as a reseller of prepaid mobile recharge services that are offered by telecommunications service providers or their distributors. Any issues related to the talk-time or the quality or anything as such will be between you and the respective Telecom company. Vastpay will not be held liable for any problems related to the talk-time, cost or expiration. All these terms and conditions are also applicable to other recharge services offered by Vastpay, like DTH recharge, Metro recharge, and other prepaid recharge products. Vastpay shall not be held liable for any recharge failure on the part of any of it's recharge partners.

Refund Policies

On the Vastpay Platform, all prepaid recharge sales are final, with no refunds or exchanges available. You are liable for the phone number or DTH account number for which the prepaid recharge was purchased, as well as any expenses incurred as a consequence of such transactions. You are also responsible for data card and toll-tag recharge information, as well as any expenses incurred as a result of such transactions. However, if your recharge has not been delivered but your money has been deducted from your account, you should immediately contact Vastpay through an email and attach all the details, such as the mobile number (or DTH account number or data card or toll-tag information), recharge value, transaction date, operator Vastpay will look into the matter and if your transaction turns out to be valid, then your money will be refunded within 21 days from the date of receipt of your e-mail.

Bill Payments

With Vastpay, we provide you with the facility to make sure that none of your phone, electricity, television or any other bills remain pending. You will require access to the World Wide Web or the Internet, either on a computer or on any other device that can access web-based material, and you will also need to pay any service costs connected with such access in order to use the bill payment service or any other Vastpay service. You must have all of the required equipment to connect to the World Wide Web or the Internet, which includes a computer and a modem or other access device. Vastpay and/or a Vastpay business partner (including Vastpay's bill payment partners) reserve the right to levy and reclaim fees for using the service. Vastpay shall be right to charge and reclaim from you, and you shall be obliged to pay such charges to the bill payment service provider as may be determined by Vastpay, if you halt or seek a reversal of the payment instructions that have been issued. These costs will be applied to your chosen payment account or in any other way that Vastpay deems appropriate. Vastpay is a simple and safe way to make payments to identified billers using a verified payment account. Depending on the Vastpay business partner you use to access the given service.

1. The service might have some precise terms, conditions, or features.
2. The service may have a different number of billers available.
3. Payment accounts that may be used to provide payment instructions vary in form and range.
4. It's possible that the modes/devices via which the service can be accessed vary.
5. The costs and fees for using the service or other parts of the service may change. Particular details related to these aspects would be available with the Vastpay business partner on their channel over which the service is being offered. Vastpay has the right to add to or remove from this list of billers or types of payment accounts that can be used to make payments to a biller at any time. Depending on the biller's criteria, the kind and range of payment accounts that can be utilised to make payments may vary. Extra fees may be charged for using certain types of payment accounts in respect of a biller. Depending on whether a card or a bank account is used to issue the payment instruction, the terms on which a payment can be made to a biller may differ. Payments to a biller can also be done.
   • By giving a payment instruction for an online debit/charge to a payment account or
   • By scheduling an automatic debit/charge to a payment account, depending on the specific capabilities permitted by a Vastpay business partner. Upon using the bill payment service, you agree to:
   • Provide the right and accurate information/details about yourself. If you provide inaccurate information, Vastpay can terminate your account and terminate your utilization of the Vastpay platform and services.
6. If Vastpay is unable to effect any payment instruction on the payment date due to one or more of the following conditions, Vastpay accepts no responsibility and shall incur no liability:
   • If you offer payment information that is incomplete, incorrect, invalid, or delayed;
   • If there are insufficient funds on the payment account to cover the amount specified in the payment instruction.
   • If the money in the payment account is restricted or charged in any way.
   • If the biller does not process your payment right away.
   • Circumstances outside Vastpay's control (including, but not limited to, fire, flood, natural disasters, bank strikes, power failure, systems failure like computer or telephone lines breakdown due to an uncertain reason or intrusion from an outside force).

If the payment hasn’t been affected for any of the given reasons, you’ll be notified via mail.

Bus Tickets

With Vastpay, you also have the freedom to make bus bookings so that you can travel tension free. Avoid all the long queues and the problems that come along, because we offer you the opportunity to precisely check the bus schedules and seating plans at the click of a button. Just check the availability of buses, seats and timings and book within minutes with Vastpay. However, please note that Vastpay is only an agent or a mediator and does not own the buses or such transport services. It only has a tie up with the bus operators in order to provide a comprehensive choice of bus operators, departure times and prices for customers.

Vastpay is only responsible for:

1. Issuing a valid and authentic ticket.
2. Refunding money and rendering support in the event of cancellation.
3. Providing information and support related to the customer’s bookings.

However, Vastpay is not responsible for:

1. The bus not being on time.
2. The employees of the bus company acting in an unprofessional or illegal manner.
3. The bus operator's bus seats, for example, if they do not meet the customer’s expectations.
4. The bus company cancelling the journey for any reason.
5. The customer's luggage gets lost, stolen, or destroyed.
6. Any change to the seating plan of the customer due to some emergency.
7. Changes in the bus operator’s plans or using a pick-up car to transport clients to the bus departure point from the boarding stop.
8. A shift in the departure or arrival timing. However, the bus will not leave before the given time.
9. You not having a printout of the ticket emailed to you.
10. f you’re not allowed to board the bus if you don’t have an identity proof.

Additionally, passengers must be aware of this policy:

1. If the bus operator changes the type of bus for any reason, Vastpay will refund the differential amount of money back to the customer after being intimated about the same.
2. The tickets will only be cancelled as per the cancellation policy attached to the ticket and no money will be refunded if such is the case.
3. Vastpay has no role in the amount of money that will be charged upon the cancellation of the ticket. It solely depends on the bus operators.
4. All the cancellation charges will be charged on the ticket’s actual amount and not on the discounted version of it.
5. If a booking confirmation e-mail or SMS is delayed or fails due to technical issues, such as the user providing an invalid e-mail ID or phone number, a ticket will be considered "booked" as long as it appears on the Vastpay Platform's confirmation page.
6. The bus service provider has set and given the amenities displayed on Vastpay for the buses (bus operator). Unless there are certain exclusions on specific days, these amenities will be supplied. Vastpay offers this information in good faith in order to assist travelers in making a wise decision. Vastpay’s travel partners are responsible for providing video, air conditioning, and any other features listed on the buses. Any refunds or disputes resulting from the non-functioning or unavailability of these services must be handled directly with the bus company
7. Vastpay is not liable for any trip discomfort, damage, or death that occurs during or as a result of the journey.
8. The traveler would be given 15 days to resolve any issues relating to cancellation or refund. After that the request will not be processed.
9. Vastpay might collect feedback from you via phone calls or emails regarding your booking or the bus facilities and/or services of the bus operator

In the event that an airline is declared insolvent or bankrupt, refunds are available.

In case the airline that you have booked through us closes it's operations or declares it'self as insolvent or has been declared as insolvent in any legal proceedings, then it will not be the responsibility of Vastpay. You shall not hold Vastpay liable for any of your refunds.

Movie Tickets

We understand your spontaneous movie plans and, even more, the importance of a movie date being planned within a couple of minutes. With Vastpay, you can search for all the cinema halls across the city and the availability of seats as per the different movies and, of course, the show timings. Why waste time booking a ticket physically when you can do it while doing a task side by side? Vastpay is a go-between and merely facilitates the sale and purchase of movie tickets between the cinema owner and the customer. Vastpay helps you save both time and energy, because you should never be late and tired for your favorite movie! Vastpay take responsibility for the products or services offered by the merchant (cinema owner), nor does it assert any rights or claims over the products/services offered by the merchant to the customer. You clearly agree and acknowledge that:

1. You cannot cancel, exchange or get a refund once the bookings have been made by you.
2. Your booking will be confirmed by you via email or SMS.
3. If someone is collecting your ticket on your behalf, then they should present a print of the emailed ticket in order to avail the physical ticket.
4. It is essential for you or the person collecting the ticket on your behalf to produce the debit/credit card that was used to buy the ticket, as well as the booking confirmation SMS or e-mail printout, to collect the tickets from the cinema box office.
5. The owner of a physical ticket is presumed to be the person who has it, and you will be charged a booking fee for any tickets you purchase online.
6. Children more than the age of 3 will be charged in total by the merchant.
7. A duplicate ticket cannot be provided if a physical ticket is lost or misplaced, according to the merchant's terms and conditions.
8. Vastpay shall not be held liable if the merchant cancels the event. Within 48 hours of the cancellation, Vastpay will immediately provide a refund to Your Vastpay wallet, less any applicable deductions, for the amount paid by you for the movie ticket bought on Vastpay.
9. Report to Vastpay if you do not receive a confirmation message or if you receive an error message.
10. By booking a ticket on the Vastpay Platform, you agree to abide by and comply with the terms and conditions of the relevant merchants in relation to any ticket reservations made through the Vastpay Platform.
11. Outside food and beverages are not permitted within the movie theatre, according to the merchant's terms and conditions
12. By abiding by the terms and conditions of this section, you accept that Vastpay has the authority to send you alerts to the linked mobile number or email.
13. You are guaranteed a 100% refund if you cancel your ticket within the time as per the cancellation policy.
14. You will receive a booking confirmation SMS/email after buying the ticket(s) with cancellation protection. Please keep in mind that your booking confirmation is not your ticket, and you will not be allowed to enter the theatre with it.
15. Please note that only the amount spent on the ticket will be refunded and not any other costs such as (food, beverages or cancellation cost).
16. Even if the tickets aren't cancelled, the Cancellation Protect fees are non-refundable. It is not possible to cancel part of an order as well. Vastpay reserves the right to alter the terms or discontinue the offer at any time without prior notice, Vastpay has the right to suspend any user's capacity to participate in the programme at any moment for any reason.
17. The Cancellation Protect feature gives you a better return guarantee when you book movie tickets through Vastpay. The Cancellation Protect function is only accessible in a few theatres and for a restricted number of seats.
18. The seating plan and the layout might differ in actual.
19. In cases of disputes, Vastpay’s decision will be final.
20. If the client cancels the tickets, the benefits of any applicable promo code on the order will be considered redeemed / satisfied.

Cinema Cancellation Policy

1. Cinema Partners may opt to provide movie ticket cancellation flexibility at their discretion.
2. Customers would have access to this data at the time of booking. Customers should double-check all information before purchasing tickets.
3. Cinema Partners have the right to alter the reimbursement slab for ticket cancellations at any time and without notice. Customers will get the benefits of Cinema Partner's cancellation policy as is, and Vastpay has no rights or influence over the cancellation policy
4. Charges for the cancellation policy laid by the cinema owners might vary from time to time.
5. The cinema owners might or might not offer some cancellation policy benefits as per their own will.
6. For a seamless customer entrance flow within the premises, we may share booking information with Event/Cinema Partners providers, such as Booking ID, customer phone numbers, and email ID with Cinema Partners, Event Managers, Promoters, and others. Such information would be utilised to ensure a seamless booking experience and to provide partners with loyalty or reward points advantages.
7. If the client cancels the ticket(s), the benefits of any applicable promocode on the order will be regarded redeemed / satisfied.

Vastpay Marketplace – Travel

Vastpay simply offers online marketplace services through it's Vastpay Platform to support listings/bookings by aggregators directly and/or through it's merchants, as you recognise and accept (including flights, hotels, and bookings of cars or hire, and price comparisons, and much more). The Marketplace Terms, which includes trip booking services, are an essential element of the Agreement and T&Cs. These bookings are subject to the terms and conditions of the relevant aggregator. Before making any bookings for hotels, flights, car rentals or other services using the Vastpay Platform, please read the terms and conditions offered by the merchant/vendor. You agree and recognise that the real sales contract is between you and the merchant/vendor. Vastpay offers you various informative services. Vastpay is neither a travel nor a booking agency nor a last-mile service provider for you, and as a result, Vastpay will not be held accountable for any errors in the aggregator's or merchant's content/booking/listing services. Vastpay is likewise not in charge of determining or regulating the rates for such searches and bookings made through the Vastpay Platform. All such listings/bookings are supplied by the aggregator directly or through it's merchants/vendors, and are subject to the aggregator's or merchant's/vendor's terms and conditions. Vastpay has no control over or prevents changes to the published details and descriptions of the aggregator's or merchant's websites/apps, and is not liable for any content included within. Vastpay has no responsibility over the products listed, including their existence, quality, safety, or legality; the accuracy of the aggregator's content or listings; or the aggregator's and merchant/vendor's ability to sell items or offer services. Vastpay doesn't take any purpose of your time throughout any dealings between you and the aggregator/merchant/vendor, or take possession of any of the listings or bookings offered by the aggregator/merchant/vendor. Nor will Vastpay at any point assert any rights or claims over identical offers offered by the aggregator/merchant/vendor to you. In using the net marketplace service, you expressly agree and acknowledge that:

1. Vastpay makes content/listings/bookings supplied by aggregators available through the Vastpay Platform, either directly or through it's merchants/vendors. The availability of such bookings/listings is subject to the conditions of the offer for sale, as well as any extra terms provided by the aggregator.
2. Vastpay does not guarantee the information, listings, or reservations made available on Vastpay by various aggregators or merchants. You acknowledge that any issues or disagreements about the warranty, guarantee, quality, or service will be handled in accordance with the aggregator's or merchant's/vendors' terms and conditions, and you agree to solve various issues and disputes directly between you and the aggregator or merchant/vendor. You recognise that Vastpay makes no representations or warranties, explicit or implied, about the use or availability of the online marketplace service or reservations made via the online marketplace.
3. Vastpay may, at it's discretion, give marketing promotion advantages on all or some of the items or services, such as gift vouchers, cash back, free gifts, and so on. Vastpay is not responsible for any errors or omissions in listings/bookings, product content, or aggregator or merchant/vendor services acquired over the Vastpay Platform. Vastpay will not be liable for any claims, including but not limited to any misrepresentation by the aggregator or the merchant/vendor in it's content/listings/bookings.
4. The Vastpay Platform makes generic Third Party Content accessible. Third-Party Content will also be available in the Vastpay e-mail that you get. In such situations, Vastpay will not be liable for any infringement of a third party's intellectual property rights or privacy rights. The distribution of third party content is only for the purpose of providing general information. You recognise that the Third Party Content supplied to you was acquired from reputable sources. Vastpay makes no warranties or representations about any Third Party Content, and Vastpay will not be liable for any harm you may incur as a result of your reliance on/or use of such Third Party Content. You should contact such a third-party site/app for information on their terms and conditions, privacy policies, complaints, and clarifications pertaining to various features and offers, as well as the products and services they provide.
5. Please double-check the visa and passport requirements for your trip. Vastpay is not responsible for visa difficulties, inaccurate passport information, or any other issues arising under the laws of India or any other nation.
6. Refund and cancellation: Cancellation or refund of bookings and charges, if applicable, shall be regulated by the aggregator's or merchant's terms and conditions. Vastpay is uninvolved in the regulation of refund/cancellation fees. Vastpay, as an online marketplace service provider, shall not be liable for any refunds or cancellations, including any fees incurred as a result. The aggregator or merchant/vendor is entirely responsible for the content/listings/bookings made accessible on the Vastpay Platform, and you should refer any questions to the individual aggregator or merchant/vendor.
7. By accepting the T&Cs in general, including the SSOID terms and the Marketplace Terms, you agree that Vastpay may send alerts to the mobile phone number/email address you gave when registering for the Vastpay Service/Vastpay Platform, or to any number/email address you later changed and informed.
8. Vastpay will not be liable to you for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages (including, without limitation, lost business chances, lost revenues, or lost anticipated gains, or any other pecuniary or non-pecuniary loss of any nature) arising out of or relating to:
   • This Agreement, which includes these terms and conditions as well as the Marketplace Terms.
   • The SSOID Agreement.
   • The Vastpay Platform, or any other reference site/app/platform/service.
   • Even if Vastpay or a Vastpay authorised representative has been warned of the risk of such damages, your use or inability to use the Vastpay Services, the Vastpay Platform (including any and all materials), or any reference sites/app/platform/services.
   • You acknowledge and agree that Vastpay has offered it's products and services, set it's prices, and entered into this Agreement based on the guarantee disclaimers and legal liability limit's set forth in this Agreement. The guarantee disclaimers and the restrictions of legal responsibility set forth herein replicate an inexpensive and truthful allocation of hazard between you and Vastpay, and that the guarantee disclaimers and the restrictions of legal responsibility set forth herein shape the crucial foundation of the good buy between you and Vastpay. Without these restrictions, Vastpay would be unable to deliver the services to you in a cost-effective manner. Because relevant legislation may not entirely enable the restriction or exclusion of responsibility or incidental or consequential damages, the foregoing limitations or exclusions will apply to you if applicable law does not allow otherwise. Vastpay liability shall be restricted to the maximum degree permissible by relevant law in such instances. This paragraph, together with these T&Cs, SSOID conditions, and Marketplace Terms, will survive the termination of this Agreement.
9. Dispute Resolutions: If any dispute, controversy, or claim arises under this Agreement or in relation to any Vastpay Service or the Vastpay Platform, including any question regarding the existence, validity, or termination of this Agreement, these T&Cs, or these Marketplace terms, the parties shall use their best efforts to resolve the dispute amicably. Vastpay may decide to resolve any dispute by binding arbitration in accordance with the terms of the Indian Arbitration & Conciliation Act, 1996 if the parties are unable to resolve the dispute amicably within 30 days of the notification of such dispute (hereinafter Act). This dispute will be arbitrated on an individual basis, and will not be combined in any arbitration with any other party's claim or disagreement. A solitary arbitrator, chosen in line with the Act, will determine the dispute. The arbitration will take place in New Delhi, and the language of the proceedings will be English. Either you or Vastpay might also additionally search for any meantime or initial alleviation from a courtroom docket in a position jurisdiction in New Delhi to defend the rights or the belongings belonging to you or Vastpay (or any of our agents, suppliers, and subcontractors), pending the finishing touch of arbitration. 10. Jurisdiction: You agree that any claim or disagreement you may have against Vastpay must be handled by a court with jurisdiction in New Delhi, India, subject to the Dispute Resolution section above. For the purpose of resolving all such claims or disputes, you agree to submit to the personal jurisdiction of the courts situated in New Delhi, India. The law of India will govern this agreement. This provision will remain in effect even if the Agreement is terminated.
